Tasman Bay Berries grows boysenberries at Tangle Farm in Hope, Nelson, and makes BOYZEN™ boysenberry ingredients. This policy explains how we collect, use, store and share personal information through our website, www.tasmanbayberries.co.nz, and when you contact us.

We follow the New Zealand Privacy Act 2020. In this policy, "we", "us" and "our" mean Tasman Bay Berries.

What we collect

When you send an enquiry through our contact form, we collect the details you enter. Depending on the type of enquiry, this can include:

  • your name, email address and phone number
  • your company, job title, type of business and country
  • the products and applications you're interested in, expected volumes, project stage and shipping terms
  • a delivery address, if you ask for a sample
  • your message, and how you heard about us
  • whether you'd like to receive occasional BOYZEN™ news

With your enquiry we also record the date and time, the page you sent it from and, if you arrived through one of our campaign links, the campaign details in that link (for example, which newsletter or advert it came from).

When you email or phone us, we collect the information you choose to give us.

When you visit the website, some technical information is collected automatically. See "Website analytics and cookies" below.

How we use it

We use your personal information to:

  • reply to your enquiry, for example to send samples, specifications, technical documents or a quote, or to arrange a farm visit
  • keep a record of our conversations and business with you
  • send you BOYZEN™ news, but only if you've asked for it
  • protect our website and contact form from spam and misuse
  • understand how our website is used, so we can improve it
  • meet our legal obligations

We only use your information for these purposes, or for purposes directly related to them.

News and updates

We'll only send you BOYZEN™ news if you tick the box on our contact form or ask us to. Every message lets you unsubscribe, and you can also email us at any time to stop receiving it.

Who we share it with

We don't sell or rent your personal information. We share it only with:

  • service providers who help us run our website and reply to you: Vercel (website hosting and analytics), Amazon Web Services (sends the emails from our contact form through Amazon SES), Google (reCAPTCHA spam protection) and the provider of our email inbox
  • a courier, if we send you a sample
  • anyone we're required to share it with by law

These providers may only use your information to provide their service to us.

Information stored overseas

Some of our service providers store or process information outside New Zealand, including in the United States and India. When we use them, we take reasonable steps to make sure your information is protected in a way that is comparable to the protection it has under New Zealand law.

Website analytics and cookies

We use Vercel Web Analytics to count visits and see which pages are most useful. It doesn't use cookies, doesn't follow you across other websites and doesn't identify you. It records general information such as the page visited, the website that referred you, your country, and the type of device and browser you use. We also count how many enquiries are sent, by enquiry type and product, without any personal details.

Our contact page uses Google reCAPTCHA to stop spam. reCAPTCHA collects information about your device and how you use the page and sends it to Google for analysis, and it may set a cookie. Google's Privacy Policy (policies.google.com/privacy (opens in a new tab)) and Terms of Service (policies.google.com/terms (opens in a new tab)) apply.

Like all websites, our hosting provider keeps short-term technical logs, such as your IP address, browser and the pages requested, to run the website securely.

We don't use advertising or social media tracking cookies.

How long we keep it

We keep your information only for as long as we need it. If your enquiry doesn't lead to ongoing business with us, we delete it within two years. Records of sales and supply are kept for seven years, as New Zealand tax law requires.

How we protect it

Our website uses encrypted connections (HTTPS). Our contact form checks every submission and blocks automated spam. Only the people who need your information to help you can see it.

If a privacy breach is likely to cause serious harm, we'll tell you and the Privacy Commissioner, as the law requires.

Seeing, correcting or deleting your information

You can ask to see the personal information we hold about you and ask us to correct it. You can also ask us to delete it, or to stop sending you news. Email info@tasmanbayberries.co.nz with your request.

We'll respond within 20 working days. We may need to confirm who you are before we share or change any information.

Questions and complaints

If you have a question or concern about privacy, please contact our Privacy Officer using the details below. If you're not satisfied with our response, you can contact the Office of the Privacy Commissioner at privacy.org.nz (opens in a new tab).
